1. Acceptance of Terms
By downloading, installing, or using the DNSwitcher application ("the App"), provided by ENERGY MARKETING SOLUTIONS LIMITED (a company incorporated in Belize, Reg. No. IBC 125.492, with its registered office at Corner Hutson & Eyre Street, Blake Building, Suite 302 Belize City, Belize) ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. By accepting these Terms and Conditions, you are entering into a legally binding agreement with us. If you do not agree to these terms, you must immediately cease using the App and uninstall it from your device.
2. Description of Service
The App is a utility tool designed to facilitate the modification of Domain Name System (DNS) settings on your device. The App does not create a secure tunnel to a VPN Server. All network traffic is still handled by the internet service provider. The App is provided free of charge and is intended for personal, non-commercial use only.
3. License Grant
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App on a device owned or controlled by you, strictly in accordance with these Terms. We reserve the right to terminate this license at any time, for any reason, without prior notice.
4. User Responsibilities and Risks
You acknowledge that changing DNS settings is a technical process that affects how your device connects to the internet. You are solely responsible for ensuring that the DNS servers you select are trustworthy and compatible with your network environment.
You understand that using certain DNS settings may expose you to security risks, including but not limited to phishing, data interception, or redirection to malicious websites. You assume all risks associated with such changes.
5. Prohibited Conduct
You agree not to:
Modify, reverse engineer, decompile, or disassemble any part of the App.
Use the App for any illegal purposes or to facilitate access to illegal content.
Interfere with or disrupt the integrity or performance of the App.
Circumvent any technical measures implemented in the App.
6. Intellectual Property
All rights, title, and interest in and to the App, including but not limited to the software code, design, graphics, and trademarks, are and will remain the exclusive property of Energy Marketing Solutions.
7. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:
Warranties of merchantability or fitness for a particular purpose.
That the App will be error-free, secure, or uninterrupted.
That the DNS changes will improve internet speed or privacy.
That the App will be compatible with all devices or network operators.
8. Limitation of Liability
In no event shall Energy Marketing Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Loss of profits or data.
Device malfunction or "bricking."
Loss of internet connectivity.
Unauthorized access to data resulting from your choice of DNS provider.
9. Indemnification
You agree to indemnify, defend, and hold harmless Energy Marketing Solutions and its officers, directors, and employees from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the App or your violation of these Terms.
10. Modifications to the App and Terms
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We may also update these Terms from time to time. Your continued use of the App after such changes constitutes acceptance of the new Terms.
11. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belize, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Belize.
